We reserve the right to suspend services for accounts with overdue payments after appropriate notice. All fees paid are non-refundable unless explicitly stated otherwise in your service agreement.

Limitation of Liability

To the fullest extent permitted by Austrian law, aqualuxisum AG's total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim during the twelve months preceding the incident.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

This limitation applies to all claims, whether based in contract, tort, strict liability, or any other legal theory. Some jurisdictions may not allow certain limitations of liability, so these limitations may not apply to you.

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless aqualuxisum AG, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

Termination

Force Majeure

In the event of force majeure, the affected party shall promptly notify the other party and use reasonable efforts to mitigate the impact and resume normal performance as soon as practicable.

Severability

Entire Agreement
